An offender is trusted to remain in the community. Available for all crimes without a minimum sentence. Can have conditions that can be used to help the offender stay out of jail. R v shoker- found that court must make probation conditions that connect to the crime, and public protection. Cant make you go to treatment programs as a stipulation. Can get around rules by making them go to counselling programs rather than treatment programs. Probation is by the courts, while parole is by the national parole board. Probation of offenders act 1907 established a probation system in canada. Supervised probation for youth started in 1908 and and for adults 1921. Archambault- national royal commission into correctional services in 1938 was the rst to recommend that adult probation be extended, also recommended making a national system. Admissions- a statistic whether probation use is increasing or decreasing. Daily count- how many probationers are under watch by probation of cers.
