Document Summary

Courts: courts are set up to resolve conflicts of claims or rights whether it be between an individual or organizations or both (private or governmental) In the judicial system, judges are expected to determine the punishment according to the law and not by personal preference. Dispute categories: sheldon goldman and austin sarat explain that there are three different categories of dispute which represent, for the most part, the workload of canadian courts. 1) private dispute: any event that takes place between husband and wife, two companies, two businesspeople, or any two parties, is a private affair. Even though it takes place in public, it is considered a private dispute as long as the government is not a party. These disputes may be settled through negotiation or bargaining but the court may be asked to do so if the party requests to seek legal advise.
