Brought about due to events occurring at harvard law. Dr. derrick bell was the only black member of the faculty at the time. The school was concerned that dr. bell would leave for another school. Challenges dominant ideas that we all have about the law. Common questions asked by the critical race theory: Not addressing the consequences (by not talking about race) we are perpetuating ideas around colour blindness and sustain the system where people are marginalized. History and context are important (long lineage) Example: lousiana plantation home and slave cabins (fundamentally shapes the social relationships) However, we still have racism in canada. If racism is not addressed, we cannot enact social change. Example: indian act, reserve system, chinese immigration act. How is race and racial power constructed and represented within american legal culture. There is no one perspective, theory, methodology, or doctrine. Understand creation and maintenance of white superiority and subordination of people of colour.
