The concept of worker"s compensation was developed to allow injured employees to be compensated appropriately without having to take their employers to court. Employees give up their right to seek unlimited compensation through the legal system employers award the prescribed compensation regardless of employee negligence. Before workers" comp. laws were enacted, injured employees could not obtain compensation for their injuries, except in court. While common law required safe and healthy work environment, employees bore the burden of proof that employer negligence contributed to injuries. Contributory negligence was a factor in the accident. There was negligence on the part of a fellow worker.
