Chapter 14: termination and severance pay requirements under the esa: Under the esa employees are entitled to receive notice of termination or pay in lieu of this notice unless the termination fall within one of the limited statutory exceptions. Under s. 56 an employers is not required to provide notice of a temporary layoff even if it offers no recall date. Temporary layoff can last only a certain length of time. If it last for longer it is considered as a termination and thus will have to provide statutory termination pay. It is longer than 35 weeks in a 52 consecutive week and a union represents the employer and the employer calls back the employee within the date agreed in the collective agreement. Under s. 56(3): a week layoff generally means a week in which an employee receives less than half of his regular earning for a regular workweek.
