An appeal to the board is an appeal to novo. Municipality is ruled by people, therefore developers go to the board for an outside decision that differs from the peoples. The charter is the law of the land, everything must conform to the charter, all levels must. 11b is right to trial, if you are charged you have a right to trial. Municipalities fall under the charter, by laws must as well, actions too. Omb statutory makers has the right to keep the charter in mind in its decision. Need to determine if the tribunal questions the law or fact finding. The board has to take the charter of rights into consideration. Establishes policies for how land will be used. Section 17 of the planning act is our focus. Official plans have to be clear and unambiguous. And official plan is not legislation, law, statute, broad policy statement.
