M IDTERM • 2 new readings • Un convention – what is it, what its all about, why it came about • Intro – historical perspective • Why the rules are there and what  its about • JDA • YOA • Procedural issues • YCJA • Bill c­10 • UN convention – section she focuses on in class • Conceptual frameworks –chapter 5 is not being covered anymore • Slides on trends will be important • Short answer and multiple choice UN C ONVENTION  ON  R IGHTS  OF  THE   C HILD  – I MPLICATIONS  FOR  C ANADA C HILDREN S RIGHTS • Children’s rights movement has a long history • Idea of rights for children creates controversy o Lots of countries depend on child labour o Creates responsibilities for the government – if they have a right to school the government has to  provide schools • Previous 30 years have seen significant international development E VOLUTION  OF  RIGHTS : P HASE  1 • Colonial times to 19  century: children viewed as possessions for parental objects o Property like animals • “reasonable chastisement” – however they saw fit, including corporal punishment • Not protective legislation, no separate system of justice • Children were vulnerable to abuse, neglect, exploitation and brutality • No age for criminal responsibility • No status P HASE  2: th • Confederation to mid 20  century: views about children changed dramatically • Seen as special class of immature persons • Some status • State has some sort of responsibility to protect them • Vulnerable, but possessing rights • Children continued to be views as objects in need of care – “not­yets” o Object vs. subject o Subject of right = capacity to exercise that right o Object of right = need someone to make sure those rights are protected o Children seen as objects of rights • State intervention occurred in cases of maltreatment P HASE  3: • Post WW2 – empowerment of children in political, civil, and social contexts • Children seen as individuals with inherent rights, subjects not objects • 1959 UN declaration of rights of the child o Not really a law, limited power • 1989 UN convention on the rights of the child o Not really a law, limited power o Symbolic function o Cant ensure for many cou
