CRM 2300 Lecture Notes - Lecture 2: Consensual Crime, Arraignment, Public Law
Document Summary
Detection and investigation: crimes is not all reported to the police. Crime that is reported is the tip of the iceberg. Police sometimes investigate consensual crime like drug deals and such. Initiating the process: the victim will usually notify the police which initiates the process. Police must have reasonable and probable ground to believe that and individual has committed an offence. Depending on the severity of the crime, not all crime is investigated. Arrest: a police officer can arrest with or without a warrant. A warrant is issued when there is significant evidence against a person. If the police witness a crime or that a person is about to commit a crime, then they can arrest without a warrant. A citizen arrest is only done when you catch someone in the act. Arraignment within 24 hours (being summons to court) Plea bargaining: pleading guilty to a charge for a reduced sentence.
