The source of power/authority to make environmental law: City of ottawa laws = section 92(8) These provincial laws that create municipalities are known as enabling laws/statutes . Municipalities exercise powers dedicated by them by enabling laws. Six sets of municipal powers: environmental powers, public health powers, planning and zoning powers, business licensing and regulation powers, dangerous substances powers, plenary powers. Constitution act: the constitution is the supreme law in canada. Any law that is inconsistent to the constitution is void. Federal or provincial governments can only exercise power conferred on them by the constitution, otherwise such exercise is void. Level of government in canada is federal parliament, then provincial government. The federal parliament has the power to make law for the peace, order and governance of canada. 91(1-29) only the federal government can legislate this sections. Any law made by the federal government under section 92 will be void/null.
