What values underlie the notion of competence: protecting well-being, promoting self-determination. Standard varies w/ the consequence of the decision. Broadly: high stakes decision requires a high degree of competence, medium stakes decision requires a medium degree of competence, low stakes decision requires a low degree of competence. Seem to suggest that different standards may apply to whether a person accepts or rejects a treatment, when there are differential consequences of accepting or refusing treatment. Seems to violate the idea that competence is all about identifying who is making decisions. High stakes takes high standards: competence was meant to determine who makes the decision, this seems to put the physician in the position of overriding decisions that disagree w/ medical judgment. Each of us has a right to be treated as a person. We each have a duty to respect persons, and this includes an obligation to recognize autonomy when present.
