Related to aids epidemic, which at the time was a disease, not many knew much about. In the mid 80s they discovered that blood transfusions could carry the aids virus. They set up a compensation fund to compensate victims who received tainted blood from the canadian blood supply. The victims eligible were victims who contracted disease from 86" to 90". Those who contracted between these dates received compensation for negligence. The difference between pre 1990 hep c compensation focuses on: breach of standard of care. This is because before 1986 no hospitals were tested for this disease. Defense against breach of standard of care: prove that you"re doing what the standard is. Ex: doctor sued for malpractice brings in 10 other doctors to testify that they would do the same. Previous example: titanic"s lifeboat ratio is an example of: duty of care. We slowly lose our ethical footing one step at a time.
