Defence: whelan as political as anyone else, and may have made inflammatory statements in the heat of an election campaign. Not unusual behaviour: certainly not evidence of a desire to actually commit murder. Of the 6 bullets that were fired: first 5 were older and the 6th was shiny and new. Crown: whelan had a gun, and everyone had seen him with it. Same type as used in murder of mcgee. He fired a single shot, then replaced the spent bullet.
