PHIL 2050 Lecture Notes - Lecture 3: Logical Truth, Specific Performance, Positive Law
Document Summary
Two kinds of law: divine law: made by god, directed to intelligent human beings, human (positive) law: positive law is set by superiors to inferiors, all laws are commands. Commands consist of 2 elements: expresses a wish on behalf of the commander. The command is backed up by coercive force. If you"re under duty you have a decision whether you do it or not: laws are general: laws direct toward a type of action, rather toward a specific performance, superior: capable of giving laws to inferiors. Superior has to have a certain amount of power over the inferior. Power to enforce his or her commands: all laws meant from superiors is a tautology- the logical truth, superiority:divine law : hierarchy of powers in the political system. Human law and divine law as well there is a hierarchy. God essentially has the most power over you, austin says you should obey.
