The difference is that prisons are for people who are serving less than 2 years and people who are being charged with indictable offences that are being waited to be transported to federal institutions. The supreme court rejected harm principle as a principle of criminal law. Illegal substances/drugs- the criminal law exists when there is a regulatory scheme. The government uses criminal law to deal with things that are considered harmful.
