This is because the supreme court does not want to substitute their definition of harm for the federal. They want to be in the business of invalidating the laws that are made for public good. A law that has been made validly can become invalid when goes up against the charter of rights and freedoms. That is why only through charter challenges people can challenge the validity of laws. The supreme court when comes of division of powers tends to stay out of business of evaluating the substance of any law because whether the law works well or not is not enough grounds to deem it invalid. Is it not about if the law is going to work, its about if there is jurisdiction to create the law.
