Under the same set of facts there could be a tort and a crime: ex. Car accident drunk driving (crime) and injure someone (tort) Most common type of tort negligence: do not intend to harm anyone but we do not act reasonably. Tort not guilty of something but rather liable: civil: liable, criminal: guilty. The defendant owed a duty to the plaintiff: breach of duty. The defendant should get in trouble if he does breach that duty: causation.
