LAW 201 Chapter x: Law readings module 7
Document Summary
Tort law is an area of private law with certain types of wrongful conduct, and the remedies available to those affected by that conduct. It is primarily concerned with providing a means of compensation. Depending on the conduct in question, it can serve other purposes, such as deterrence and punishment. A tort is a type of civil wrong for which the person wronged can obtain damages. Tort comes from the latin word tortum meaning something twisted . A civil wrong is a wrong defined by private law, which covers the relationships between persons. Tort law is seen as a residuary category within private law in other words, a catch- all miscellaneous category that includes all those civil wrongs that are not covered by other areas of private law. Modern tort law is divided into four categories, based on the type of fault involved: intentional torts, negligence, strict liability torts, a miscellaneous group of torts.
