Chapter 4: unfulfilled crimes and participation in crimes. The provisions in this chapter cast the net of criminal liability broadly to include those who: Pg 130: attempt but fail to complete a crime, encourage or plan the commission of a crime, assist others to commit a crime. The counter balance to this broad definition is that the crown must prove beyond a reasonable doubt that the accused acted with the intent to commit the complete offence. You can be convicted for counselling or soliciting the commission of a crime. Parties to a crime - section 21(1)(b) and (c) criminal code. Those who assist the person committing the offence are guilty as parties of the same criminal offence as the person who commits the crime. Example: the person who acts as a lookout or drives the car can be convicted of the same offence as the guy stealing.
