Civil action or civil trial- any legal action that is not a criminal action. Civil actions are between private individuals, unlike criminal actions which are between the crown and the accused the persons involved in civil action are called parties. Trial court- a court of original jurisdiction where evidence and testimony are first introduced, received, and considered. Findings of fact and law are made in the trial court, and the findings of law may be appealed to a higher court that has the power of review. Appeal court (or appellate court)- a court that hears appeals from a lower court. Burden of proof- the onus; who has the obligation to prove something that matters. Standard of proof- the level that you have to prove: balance of probabilities or preponderance of the evidence, beyond a reasonable doubt.
