Chapter 7- the structure and operation of the criminal courts. The courts are responsible for determining the guilt or innocence of the accused persons and for imposing an appropriate sentence on those convicted. Judicial independence principle holds that citizens have the right to have their cases tried by tribunals that are fair, impartial and immune from political interference. Judges of provincial and territorial courts are appointed by the provinces and territories. They dont have juries, hears cases under the youth criminal justice. Traditional distinction between the provincial and territorial courts and higher level courts blurred over the years. Problem-solving courts- specialized courts that are designed to divert offenders with special needs from the cjs. Drug treatment courts (dtc) target needs of persons with addictions who are in conflict with the law; mental health courts address needs of person with mental illness. Focus on addressing the underlying problems of offenders, victims, and communities.
