Macivor chapter 10 (224-231): fundamental freedoms (charter) s2. There"s a major difference between rights and freedoms; rights impose a positive obligation on govts to provide benefit, whereas a freedom simply requires the state to leave the indiv alone. Section 2(a): freedom of conscience and religion: freedom of conscience, freedom of religion. Two broad principles inferred from s. 2(a): while the state may not be able to restrict religious beliefs, state practice whose purpose is to enforce religious it can restrict religious practices. conformity will always infringe s. 2(a).
