About where to put the most emphasis on one of the following three: retribution: punishment should be in proportion to crime (restore balance) More severe crimes should be dealt with more severe punishment. A backwards looking approach - looking back on the crime and making the criminal pay for the crime: deterrence: punish a criminal to set an example and instill fear in others. Problem: it doesn"t seem to deter crime ex; many murders are done in the heat of the moment. It may also punish innocents to set an example: reform/rehabilitation: correct the behaviour of criminals so the individual will not reoffend. There is more of an emphasis on it. A forward looking way of punishment - we punish because we both want the criminal to pay for the crime and that we want the person to turn out better. The moral issue: concerns whether capital punishment is morally acceptable way to punish people or not.
