Chapter 8- expressed and ancillary employment contract terms: once we have an offer, an acceptance, and mutual consideration, we have an employment contract. Sources of employment contract terms: expressed contract terms- terms of a contract that the parties have explicitly agreed to, either orally or in writing, exp. These documents are separate from the employee contract, but rules and terms found in them can sometimes form part of the employment contract. Implied contract terms- terms that are read into the contract by judges to fill voids in expressed contract terms: the two most commonly litigated expressed contract terms are, restrictive covenant clauses, termination of contract clauses. Indefinite term contract- a contract that has no specified end date: can be terminated by providing notice to the other party of the intention to terminate. In canada, employment standards legislation requires notice of termination and therefore prohibits at will contracts for employees covered by the legislation.
